Please read these Terms of Use ("Terms") carefully before using the Facetron mobile application ("App"). By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. ACCEPTANCE OF TERMS

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to modify these Terms at any time. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

2. DESCRIPTION OF SERVICE

Facetron is an AI-powered image generation application that allows users to create custom images. The App offers both free and subscription-based services.

3. SUBSCRIPTION TERMS

3.1 Subscription Options: We offer weekly, monthly, and yearly subscription plans. Each plan provides a specific number of images per period, as described in the App.

3.2 Auto-Renewal: All subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Auto-renewal may be turned off by going to your Account Settings after purchase.

3.3 Billing: Payment will be charged to your Apple ID account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen subscription plan.

3.4 Cancellation: You can cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current subscription period. No refunds will be provided for the unused portion of any subscription period.

3.5 Free Trial: If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.

3.6 Price Changes: We reserve the right to change subscription fees at any time. Any price changes will apply to the next subscription period.

4. USER CONTENT

4.1 You retain all rights to any content you submit, upload, or display on or through the App ("User Content").

4.2 By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of providing and improving our services.

4.3 You represent and warrant that: (i) you own the User Content or have the right to use and grant us the rights and license as provided in these Terms, and (ii) the User Content does not violate the rights of any third party.

5. PROHIBITED USES

You agree not to use the App to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringe any patent, trademark, trade secret, copyright, or other intellectual property rights
  • Violate the privacy or publicity rights of any person
  • Impersonate any person or entity
  • Interfere with or disrupt the App or servers or networks connected to the App
  • Attempt to gain unauthorized access to any portion of the App

6. INTELLECTUAL PROPERTY

The App and its original content, features, and functionality are owned by Facetron and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

8. DISCLAIMER OF WARRANTIES

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. LIMITATION OF LIABILITY

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

10. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of Morocco/Rabat, without regard to its conflict of law provisions.

11. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
